Premises Liability

Nashville Premises Liability Cases We Handle

Tennessee law requires property owners, managers, and businesses to keep their property reasonably safe for the people who come onto it. When they cut corners on maintenance, inspections, or security, people get hurt.

Most common

Slip & Fall and Trip & Fall

Wet or freshly mopped floors, spills, ice, torn carpet, uneven sidewalks, broken stairs or handrails, and poor lighting cause serious falls every day.

Common places: grocery stores, retail stores, restaurants

Violent crime

When an owner ignores a known crime problem, with broken locks, dark parking lots, missing cameras, or no security staff, they can be held responsible when someone is assaulted on the property. Learn more about Nashville negligent security claims →

Common places: apartment complexes, hotels, bars, parking garages

Unsafe property

Dangerous Conditions

Falling merchandise, collapsing structures, unguarded pools, exposed wiring, broken elevators, and other hazards an owner should have found and fixed.

Hurt on government property?

Claims against a city, county, or the State follow the Tennessee Governmental Tort Liability Act, which has its own rules and limits. Call us right away so nothing is missed.

The Other Side’s Playbook

What Their Insurer Will Try

Tim used to sit on the other side of these cases. He knows the defenses insurers use to deny or shrink premises liability claims, and how to get ahead of each one.

“We Didn’t Know”

Owners often claim they had no notice of the hazard. We use inspection logs, prior complaints, and incident history to show they knew or should have known.

“It Was Your Fault”

Under Tennessee’s comparative fault rule, any blame shifted to you cuts what you recover. We push back with the facts of how the hazard was created.

Disappearing Evidence

Surveillance video is often recorded over within days. We send preservation demands right away so key footage and records are not lost.

The Quick, Low Offer

Early offers come before the full cost of your injury is known. We document your medical care, lost income, and future needs first.

Every day matters. Most Tennessee injury claims must be filed within one year, and evidence is easiest to secure in the first few weeks. The sooner we start, the stronger your claim.

Free Case Review

Tell us what happened. We review how you were hurt, where it happened, and your injuries, and tell you honestly whether you have a claim.

02

Preserve the Evidence

We move fast to lock down surveillance video, incident reports, maintenance and inspection records, and witness information before it disappears.

03

04

Document Your Damages

We gather medical records, bills, lost wages, and the long-term effects of your injury so the full cost is on the table.

05

Negotiate or Go to Trial

We demand fair compensation from the insurer. If they won’t pay what your case is worth, we are ready to take it to court.

What is premises liability?

Premises liability is the area of law that holds property owners and occupiers responsible for injuries caused by unsafe conditions on their property. In Tennessee, owners must use reasonable care to keep their property safe and to fix, or warn about, dangers they know about or should discover.

How long do I have to file a premises liability claim in Tennessee?

In most cases, Tennessee gives you one year from the date of the injury to file a personal injury lawsuit. Claims against government entities can follow different rules. Because the deadline is short and evidence disappears quickly, talk to a lawyer as soon as possible.

What do I have to prove in a slip and fall case?

Generally, you must show that the owner created the dangerous condition, or knew or should have known about it and failed to fix it or warn you, and that it caused your injury. Evidence that a hazard was there long enough to be found, or kept happening, can show the owner should have known.

What if I was partly at fault for my fall?

You may still recover. Tennessee follows modified comparative fault. If you are less than 50% at fault, you can recover damages, reduced by your share of fault. If you are 50% or more at fault, you cannot recover.

Can I sue if I was attacked on someone else’s property?

Possibly. In a negligent security case, an owner can be responsible when a crime on the property was reasonably foreseeable and the owner failed to take reasonable steps to prevent it, such as adequate lighting, working locks, cameras, or security staff. Prior crimes on or near the property are often key evidence.

What compensation can I recover?

Depending on your case, compensation may include medical bills, future medical care, lost wages and earning capacity, and pain and suffering. If a fall caused a head injury, see our Nashville brain injury lawyer page.

How much does it cost to hire you?

Nothing upfront. We handle premises liability cases on a contingency fee, which means we are paid only if we recover money for you. Your first case review is free.

What should I do after getting hurt on someone’s property?

Get medical care first. If you can, report the incident to the owner or manager, photograph the hazard and your injuries, get witness names, and keep the shoes and clothing you were wearing. Do not give a recorded statement to the owner’s insurance company before talking to a lawyer.

Should I talk to the property owner’s insurance company?

Be careful. The adjuster works for the property owner’s insurer, and what you say can be used to deny or reduce your claim. Let us handle communication with the insurance company.
